ALGEMENE VOORWAARDEN

Retreat Portugal

1. Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, boekingen en overeenkomsten van Retreat Portugal, waaronder retreats, privéretreats, online trajecten en digitale producten.

Door het maken van een boeking verklaart de deelnemer kennis te hebben genomen van en akkoord te gaan met deze voorwaarden.

Indien deelname plaatsvindt vanuit zakelijke hoedanigheid (B2B), zijn consumentenbeschermende bepalingen slechts van toepassing voor zover wettelijk verplicht.

2. Totstandkoming van de overeenkomst

Deelname aan een retreat verloopt via een persoonlijk kennismakingsgesprek.

Een overeenkomst komt tot stand nadat:

• schriftelijke bevestiging per e-mail is verzonden

• de aanbetaling is ontvangen

Retreat Portugal behoudt zich het recht voor deelname te weigeren indien de retreat naar professioneel oordeel niet passend is.

3. Minimale en maximale bezetting

De Elemental Reset™ Retreat vindt plaats met maximaal vier (4) deelnemers.

Een retreatweek gaat door bij een minimale bezetting van drie (3) deelnemers.

Indien de minimale bezetting niet wordt bereikt, behoudt Retreat Portugal zich het recht voor:

• de retreat te verplaatsen naar een latere datum

• of een alternatief aanbod te doen

Restitutie vindt uitsluitend plaats indien geen passend alternatief kan worden geboden.

Er bestaat geen recht op automatische doorgang bij minder dan drie deelnemers.

4. Betaling

Bij reservering wordt een aanbetaling van 30% van de totale reissom gevraagd, met een minimum van €750.

De aanbetaling dient binnen 7 dagen na bevestiging te worden voldaan.

Het resterende bedrag dient uiterlijk 8 weken vóór aanvang volledig te zijn betaald.

Bij boeking binnen 8 weken vóór aanvang dient het volledige bedrag direct te worden voldaan.

Bij niet-tijdige betaling behoudt Retreat Portugal zich het recht voor de overeenkomst te ontbinden. De betalingsverplichting blijft in dat geval onverminderd van kracht.

5. Prijzen

Alle prijzen zijn per persoon en afhankelijk van het gekozen kamertype.

Retreat Portugal behoudt zich het recht voor prijzen te wijzigen. De bij boeking bevestigde prijs is bindend.

Kennelijke fouten of typefouten zijn niet bindend.

6. Annulering door Retreat Portugal

Retreat Portugal heeft het recht een retreat te annuleren of te verplaatsen in geval van:

• onvoldoende deelnemers

• ziekte of uitval van begeleider

• overmacht

• omstandigheden die veilige uitvoering onmogelijk maken

In geval van annulering wordt primair een alternatieve datum aangeboden.

Indien verplaatsing niet mogelijk is, wordt een tegoed verstrekt met een geldigheid van 12 maanden.

Restitutie in geld vindt uitsluitend plaats indien geen redelijk alternatief kan worden geboden.

Er bestaat geen recht op aanvullende schadevergoeding.

7. Annulering door de deelnemer

Annulering dient schriftelijk per e-mail te geschieden.

De volgende annuleringsvoorwaarden zijn van toepassing:

Tot 8 weken vóór aanvang:
– 30% van de reissom verschuldigd (aanbetaling)

Tussen 8 en 4 weken vóór aanvang:
– 75% van de reissom verschuldigd

Binnen 4 weken vóór aanvang:
– 100% van de reissom verschuldigd

Bij voortijdige beëindiging of no-show bestaat geen recht op restitutie.

Annulering wegens ziekte of persoonlijke omstandigheden dient via de eigen annuleringsverzekering te worden afgehandeld.

Wijzigingen in vluchtplannen of reisdocumenten geven geen recht op kosteloze annulering of verplaatsing.

8. VIP Elemental Reset™ Retreat

De VIP retreat betreft een exclusieve privébegeleiding.

Alle inbegrepen faciliteiten zijn vermeld op de website.

Bij annulering gelden dezelfde annuleringsvoorwaarden als bij de groepsretreat.

9. Online trajecten en digitale producten

Bij aankoop van een digitaal product of online traject stemt de deelnemer in met directe levering en doet afstand van het herroepingsrecht conform EU-richtlijn 2011/83/EU.

Restitutie is niet mogelijk na toegang tot het materiaal.

10. Aansprakelijkheid

Deelname geschiedt volledig op eigen verantwoordelijkheid.

Retreat Portugal is niet aansprakelijk voor:

• medische of psychische klachten

• bestaande of latente gezondheidsproblemen

• verlies, diefstal of schade aan eigendommen

• handelen of nalaten van derden

• indirecte of gevolgschade

Retreat Portugal garandeert geen specifieke resultaten of uitkomsten.

De totale aansprakelijkheid is te allen tijde beperkt tot het door de deelnemer betaalde bedrag.

11. Medische verantwoordelijkheid

De aangeboden begeleiding is geen vervanging voor medische, psychologische of therapeutische behandeling.

De deelnemer is verplicht relevante medische informatie vooraf te melden.

Indien tijdens deelname blijkt dat deelname niet veilig kan plaatsvinden, behoudt Retreat Portugal zich het recht voor deelname te beëindigen zonder restitutie.

12. Gedrag

Bij gevaarlijk, grensoverschrijdend of storend gedrag kan deelname zonder restitutie worden beëindigd.

13. Verzekeringen

De deelnemer is verplicht zelf zorg te dragen voor adequate reis-, annulerings- en zorgverzekering.

14. Toepasselijk recht

Op alle overeenkomsten is uitsluitend Portugees recht van toepassing.

TERMS AND CONDITIONS

Retreat Portugal

1. Scope and Applicability

These Terms and Conditions apply to all offers, bookings and agreements provided by Retreat Portugal, including retreats, private retreats, online journeys and digital products.

By making a booking, the participant confirms that they have read, understood and agreed to these Terms and Conditions.

If participation takes place in a business capacity (B2B), consumer protection provisions apply only insofar as legally mandatory.

2. Formation of the Agreement

Participation in a retreat follows a personal introductory conversation.

An agreement is considered concluded once:

• written confirmation has been sent by email, and

• the deposit has been received.

Retreat Portugal reserves the right to refuse participation if, in its professional judgment, the retreat is not suitable for the participant’s situation.

3. Minimum and Maximum Occupancy

The Elemental Reset™ Retreat takes place in a small-scale setting with a maximum of four (4) participants.

A retreat week will proceed with a minimum of three (3) participants.

If the minimum number of participants is not reached, Retreat Portugal reserves the right to:

• reschedule the retreat to a later date, or

• offer a suitable alternative.

A cash refund will only be issued if no reasonable alternative can be offered.

There is no automatic right to proceed with fewer than three participants.

4. Payment

A deposit of 30% of the total retreat fee is required upon reservation, with a minimum of €750.

The deposit must be paid within 7 days of booking confirmation.

The remaining balance must be paid no later than 8 weeks before the start date.

For bookings made within 8 weeks prior to the start date, full payment is required immediately.

If payment is not received within the stated time limits, Retreat Portugal reserves the right to terminate the agreement. The payment obligation remains in force.

5. Prices

All prices are per person and depend on the selected room type.

Retreat Portugal reserves the right to adjust prices. The price confirmed at the time of booking remains binding.

Obvious errors or typographical mistakes are not binding.

6. Cancellation by Retreat Portugal

Retreat Portugal reserves the right to cancel or reschedule a retreat in the event of:

• insufficient participants

• illness or unavailability of the facilitator

• force majeure

• circumstances that make safe execution impossible

In the event of cancellation, a new date will be offered as the primary solution.

If rescheduling is not possible, a credit voucher valid for 12 months will be provided.

Cash refunds will only be granted if no reasonable alternative can be offered.

No additional compensation shall be owed.

7. Cancellation by the Participant

Cancellation must be made in writing via email.

The following cancellation policy applies:

Up to 8 weeks before the start date:
– 30% of the total fee is due (deposit)

Between 8 and 4 weeks before the start date:
– 75% of the total fee is due

Within 4 weeks before the start date:
– 100% of the total fee is due

No refund will be granted in case of early termination or non-attendance.

Cancellations due to illness or personal circumstances must be claimed through the participant’s own cancellation insurance.

Changes to flight schedules or travel documents do not entitle the participant to free cancellation or rescheduling.

8. VIP Elemental Reset™ Retreat

The VIP retreat consists of exclusive private guidance.

All included services are specified on the website.

The same cancellation terms apply as for the group retreat.

9. Online Journeys and Digital Products

Upon purchasing a digital product or online journey, the participant expressly agrees to immediate delivery and waives the statutory right of withdrawal in accordance with EU Directive 2011/83/EU.

No refunds are possible once access has been granted.

10. Liability

Participation is entirely at the participant’s own risk.

Retreat Portugal shall not be liable for:

• medical or psychological conditions

• existing or latent health issues

• loss, theft or damage of personal belongings

• acts or omissions of third parties

• indirect or consequential damages

Retreat Portugal does not guarantee specific results or outcomes.

Total liability shall at all times be limited to the total amount paid by the participant.

11. Medical Responsibility

The guidance provided is not a substitute for medical, psychological or therapeutic treatment.

Participants are required to disclose relevant medical information prior to participation.

If during participation it becomes clear that safe continuation is not possible, Retreat Portugal reserves the right to terminate participation without refund.

12. Conduct

In the event of dangerous, disruptive or inappropriate behavior, Retreat Portugal reserves the right to terminate participation without refund.

13. Insurance

Participants are responsible for obtaining adequate travel, cancellation and health insurance.

14. Governing Law

All agreements shall be governed exclusively by Portuguese law.

Any disputes shall be submitted to the competent court in Portugal.
